2. Purpose and scope

These Terms and Conditions govern the commercial relationship between SpanishAura (“the seller”) and any person making a purchase through spanishaura.com (“the student” or “the buyer”).

The products covered by these terms are:

(a) Online Spanish courses in digital format, including downloadable materials, videos, audios, worksheets, and any content associated with the “From Zero to Spanish” program or other courses published on the website.

(b) Live private 1:1 lessons, delivered individually via videoconference.

By completing a purchase, the buyer confirms having read, understood, and fully accepted these Terms and Conditions.

3. Purchase process

  1. The student selects the desired course or product and clicks the purchase button.
  2. Completes the payment form with personal details and payment method.
  3. Confirms and accepts these Terms and Conditions before finalizing the order.
  4. Receives a confirmation email with order details and access instructions.

The sales contract is considered finalized at the moment the buyer receives the purchase confirmation email. If you do not receive the confirmation email within 30 minutes, please check your spam folder or contact us at info@spanishaura.com.

4. Prices and payment methods

All published prices are expressed in euros (€) and include applicable VAT under current Spanish law. SpanishAura reserves the right to modify prices at any time; such changes will not affect purchases already confirmed.

Accepted payment methods:

  • Credit / debit card (Visa, Mastercard, American Express)
  • PayPal
  • Stripe or other payment gateways enabled at the time of purchase

All transactions are processed through secure, SSL-encrypted platforms. SpanishAura does not store banking data on its servers.

5. Course access and digital product delivery

Delivery occurs automatically upon payment confirmation. Access will be available for the period indicated on the product page; unless stated otherwise, access is lifetime access to the content published at the time of purchase.

SpanishAura reserves the right to update, improve, or expand the content. Improvements will be accessible at no additional cost to already-enrolled students. Course access is personal and non-transferable; sharing credentials or any unauthorized commercial use is prohibited.

6. Private 1:1 lessons

Individualized live teaching services via videoconference (Microsoft Teams or another platform as indicated).

Cancellation and rescheduling:

  • 12 hours’ notice or more: right to reschedule at no cost or receive a full refund.
  • Less than 12 hours’ notice: no right to a refund or rescheduling (except for duly justified force majeure).
  • No-show: if the student does not attend without notice, the lesson is considered used.

Recording: 1:1 lessons are not recorded by SpanishAura. Students are not permitted to record the session without prior consent. Group sessions within the hybrid course may be recorded for pedagogical purposes, with prior notice given.

Technical responsibility: the student is responsible for their own internet connection. SpanishAura is not liable for technical failures on the student’s end.

Note: This cancellation policy is a contractual condition set by SpanishAura and applies at all times. It is separate from, and does not override, the student’s legal right of withdrawal described in Section 8, which applies specifically to lessons that have not yet been delivered within the legal withdrawal period.

7. Commercial satisfaction guarantee

Independently of the legal right of withdrawal described in Section 8, SpanishAura offers a 14-calendar-day satisfaction guarantee on the “From Zero to Spanish” digital course. To request it, email info@spanishaura.com. Refunds will be processed within a maximum of 14 business days.

Excluded from this guarantee:

  • Materials already downloaded prior to the refund request.
  • Purchases made during promotions where non-applicability of refunds is explicitly stated.

This is a voluntary commercial guarantee offered by SpanishAura and is separate from, and does not replace, the statutory right of withdrawal below.

8. Legal right of withdrawal

Under Spanish and EU consumer law (Royal Legislative Decree 1/2007, “TRLGDCU”), consumers generally have a 14-calendar-day right of withdrawal from the date of purchase, without needing to give a reason. However, this right works differently for the two types of products we offer:

(a) Digital course content (“From Zero to Spanish” and similar):

In accordance with Article 103(m) TRLGDCU, the right of withdrawal does not apply once you have begun accessing the digital content, provided that:

  • You have given your prior, express, and separate consent (via a dedicated checkbox at checkout, distinct from the general acceptance of these Terms) to begin accessing the content immediately, and
  • You have acknowledged that, by doing so, you lose your right of withdrawal.

If you complete your purchase without accessing the course content, you retain your full right of withdrawal for 14 calendar days.

(b) Private 1:1 lessons:

1:1 lessons are a service, not digital content, so Article 103(m) does not apply to them. Under Article 103(a) TRLGDCU, your right of withdrawal is only lost once the service has been fully performed, and only if you gave prior express consent to that effect and acknowledged you would lose the right of withdrawal once performance was complete.

This means that if you purchase 1:1 lessons and wish to withdraw before a booked lesson has taken place, and you are within the 14-calendar-day withdrawal window, you are entitled to a full refund for lessons not yet delivered — even if this falls outside the cancellation notice periods described in Section 6, which govern rescheduling and no-shows rather than the legal right of withdrawal itself.

How to exercise your right of withdrawal:

You may notify us of your decision to withdraw by sending an unequivocal statement (e.g. by email to info@spanishaura.com) or by using the model withdrawal form below.

9. Intellectual property

All content (texts, videos, audios, methodology, etc.) is the exclusive property of SpanishAura. Purchase grants a personal, non-exclusive, non-transferable license to use the content. Reproducing, distributing, sharing access to, or publishing materials on third-party platforms is prohibited.

10. Limitation of liability

SpanishAura does not guarantee that access will be uninterrupted or error-free. SpanishAura is not liable for individual learning outcomes (which depend on student effort), interruptions caused by third-party failures, or misuse of the content by the student.

Except in cases of willful misconduct or gross negligence, SpanishAura’s total liability arising from these Terms is limited to the amount paid by the student for the specific product or service giving rise to the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded or limited under applicable Spanish consumer protection law.

11. Personal data protection

We process personal data in accordance with the GDPR and Spanish Organic Law 3/2018 (LOPDGDD) in order to manage your purchase and comply with legal obligations. 12. Changes to these terms

SpanishAura may modify these Terms at any time; the version in force at the date of the transaction will apply. These Terms are governed by Spanish law.

13. Dispute resolution

Before taking any legal action, both parties agree to attempt to resolve any dispute amicably. The European Commission also offers an online dispute resolution platform: ec.europa.eu/consumers/odr.
